Myanmar publishes draft of new Patent Law

RANGOON - As part of Myanmar's efforts to introduce an international standard of IP protection, the Government has published a draft version of what will be the Myanmar Patent Law, which aims to fully modernise the patent system. Lawyers Baker & McKenzie say the draft includes many of the same procedural and substantive provisions found in patent laws of most Paris Convention countries.

Currently, there is no patent law in Myanmar. B&M says patent owners receive only limited protection by filing a Declaration of Ownership with the Myanmar Registry Office of Deeds and Assurances. This is followed by publication of a cautionary notice in a local newspaper to advise members of the public of the patent's ownership.

“Establishment of a comprehensive IP system and strengthening of the protection of intellectual property rights (IPRs) in Myanmar is a key driving force behind realising the potential the country holds,” B&M writes in a Client Alert. “n particular, efforts afforded to protecting technical innovations are seen as imperative to promote both foreign investment and local industrial development.”

B&M points out that foreign investment in Myanmar has seen considerable growth in recent years, and that despite some enduring challenges, this has continued through 2015. Key sectors for foreign investment include those related to oil and gas, telecommunications, manufacturing, logistics, transportation, and property and hotel development.  www.bakermckenzie.com (ATI).
